The evolution of the case law of the European Court of Human Rights in the field of gender-based violence has produced some important results in identifying the obligations of States in this matter. At the same time, in some recent judgments also against Italy, the Court does not seem to pay sufficient attention to the dimension of gender discrimination as a struc- tural and often invisible factor of how violence is addressed by public insti- tutions.
