The non-pecuniary damage from a ruined holiday is an unjust injury to the person (pursuant to Article 2 of the Constitution), guaranteed – first – by the constitutionally oriented inter-pretation of Article 2059 of the Civil Code – subsequently – by the tourism code. The Court of Cassation returned to the issue of the compensability of damages for a holiday, ru-ined following the failure by the appellate court to uphold the request for compensation for breach of contract, for the psycho-physical inconvenience caused by the failure to realise the expected.
