Article 38 of the Constitution, regulating the right to social security, should be consid-ered one of the pillars of the welfare state. Its interpretation, yesterday and today, can only be built in the relationship between the principles in Art. 3(2), social solidarity in Art. 2, and Articles 4 and 36 Const. Adherence to these principles still appears necessary and practicable even after the advent of the reform of Article 81 Const. and, with it, debt sustainability and the balancing of public and state budgets. The A. reflects on the ways in which legislation in recent decades has attempted to ensure the sustainability of the welfare system, also in light of the new provision about intergenerational responsibility resulting from Constitutional Law No. 1 of 2022.
