European Directive on Corporate sustainability due diligence published on 13.6.2024 marks a turning point in the conception of due diligence from a voluntary behavior of the company within the CSR framework to a legal obligation applicable to all European and non-EU companies of large size in terms of employment and turnover generated in the internal market. Anticipated by national laws that have imposed legal obligations on companies headquartered in their own territory, the directive extends to all countries of the European Union these obligations, codifying the legal duty of care on human rights, the environment and climate change for the entire chain of business activities and affirming the principle of liability of the company for breach of obligations of conduct duly defined. In spite of the compromises that marked the approval process, this is a regulatory act of great importance for the scope of its provisions, aimed at holding large corporations accountable for the negative impacts caused to human rights and the environment by their economic activity, extended to the entire global value chain. The transposition of the directive will also require states that already have legislation in this area to make the necessary adjustments to adapt to the European standard.
