This article examines the right to personal data protection from a systematic and axiological perspective. After outlining the historical evolution from privacy to personal data protection, the analysis reconstructs the essential framework of Regulation (EU) 2016/679, with regard to its principles, the notion of personal data, special categories of data, lawful bases for processing and data subjects’ rights. It then focuses on the economic dimension of personal data, its relevance within contractual relationships and the function it performs in digital markets. Against the background of a coordinated reading of the most recent European regulatory framework, the article puts forward a reconstruction that avoids both full patrimonialisation and the reduction of personal data to a mere object of negative protection, while emphasising human dignity and informational self-determination as irreducible benchmarks also within the digital economy.
