Health care requires ever more resources, due to the technological development and the increase of chronic patients and elderly people. The major waste of resources is given by defensive medicine, the prescription of unnecessary treatments and diagnostic tests for fear of being held liable for Medical Malpractice. The defensive medicine wastes about 10% of the resources, so it’s urgently necessary to reduce it. The Balduzzi decree, instead of improving the quality of the system and the prevention of adverse events, chose to act on medical responsibility, excluding minor negligence when are followed official protocols and guidelines. However, it will reduce the appropriateness of medical practice, it will increase costs, and it does not exclude the need of criminal trials.
