In the first part of this article, the author tries to work out the overall meaning of Ferrajoli’s theoretical proposal through the analysis of the definition of "subjective rights", "fundamental rights", "human rights". While accepting the first one, he invites Ferrajoli to integrate the second with the feature Bobbio identified as typical of fundamental rights, that is the priority of these rights on duties in modern constitutions. Bovero then poses some questions on the relationship between fundamental rights and human rights, between individual rights and citizen’s rights. In the final part of the article, Bovero criticizes Ferrajoli’s use of the notion of "substantial democracy".
