The prison comes in modernity within the evolution of the penal system and shifts the punishment object from violence practiced on the guilty body to the actual freedom limitation. In our times this instrument has been enlarged until to process, in an inefficacious way, any social unrest. The diligence of penitentiary system to leave out the unconscious and the subjectivity, leads it to fail because, as psychoanalysis suggests, no change is possible without the subject’s will.
