This paper identifies and analyses the legislative provisions aimed at regulating employment relations in areas affected by fragmentation and restructuring, where public sector bodies are the protagonists and administrative and commercial law contribute to the regulation of functions and services of general interest. Under scrutiny are the "special" rules that govern employment in the public sector and the ways in which the various steps, which bring about change in the legal status of employment relations are regulated. The central role played by employment law becomes clear, together with the inadequacy of legislative interventions, characterized by fragmented rules lacking systematic coherence; hence the need for a regulatory model capable of combining the aim of protecting the weak party with guaranteeing the public interest, as well as achieving a balance between social values and economic needs.
