This comment examines the recent Italian judgment on the Foodora case. The authors highlight how the court did not make reference in its reasoning to the recent debate on the so-called "subordinazione attenuata", nor to the recently enacted Articles 2, Legislative Decree 81/2015 and 15, Law 81/2018. In the conclusion, the authors question whether the legal concept of juridical subordination and its main elements can govern the new forms of employment in the context of the gig economy.
