Property is a changing and highly debated concept. From a constitutional perspective, the political order that arose out of the bourgeois revolutions of the seventeenth and eighteenth centuries is intertwined with the foundation of the modern state and the establishment of a new economic system. This balance has undergone many transformations that did not stop with the entry into force of the post-World War II constitutions. It is still experiencing an ongoing development. This essay discusses in particular how private property is regulated at the constitutional level, dealing with its connections to economic inequality and redistribution of income and wealth.
