The Constitution qualifies itself as the fundamental law of the Republic and, as such, identifies the fundamental rules of the republican order. Private law institutions also find their basis in the Constitutional Charter: in the last paragraph of art. 42 of the Constitution, in fact, the Constituent Assembly turns its attention to succession mortis causa, of which this work aims to investigate the social function.
