The article examines the judgement of the Tar Lazio No. 10653 of 2023, which partially annulled Ministerial Decree No. 27 of 2022 (the so-called Cartabia Decree) which had excluded trade union organisations from the possibility of enrolling in the special ministerial list. The registration is required to bring class action or representative action claims (Law No. 31 of 2019). In the aftermath of the judgment numerous issues remain unanswered. The contribution suggests that inclusion in the list should be considered neither a sufficient nor a necessary condition for standing, as it is still up to the court to ascertain the existence of the conditions of the action. In particular, it should be examined the adequate representativeness of the collective organisation in relation to the interests at stake.
