Recently, Italy has witnessed an input of legislative measures aimed at reducing and com-bating juvenile delinquency and its causes. Some particularly serious acts committed by underage adolescents have been the subject of media attention and caused social alarm in the community. The so-called Caivano decree, implemented by the Italian government, aimed to provide support and educational opportunities to children from economically and culturally disadvantaged backgrounds but, in fact, shows a wider scope and heterogeneous content. On the one hand, new offences have been introduced to punish the behaviour of parents who do not fulfil their obligation to ensure that their children receive compulsory education. On the other hand, the criminal law in the minors’ field has been modified by the limitation of the scope of instruments – such as probation – which are characterised by re-education and social reintegration purposes. At the same time, this legislative reform has broadened the conditions for the application of preventive measures, bringing minors clos-er to the sphere of control of public institutions and to prison. Following this legislative change, the system of laws and regulations thus established must be analysed and its suitabil-ity to meet the educational needs and the minors’ best interests must be assessed.
