The ruling under analysis, in the context of international air transport, reiterates the impossibility of configuring non-pecuniary damages due to the carrier’s breach of contract in objective terms. It also confirms the injured party’s need to demonstrate the existence and relevance of the injury. However, a reflection on the ontological and applicative presuppositions of the category of non-pecuniary damages from breach of contract seems necessary, aimed at adapting it to the current social context to offer protection to new and unprecedented needs of the individual.
