The Author examines Public-Private Partnerships (PPPs) in light of Legislative Decree No. 36 of 31 March 2023, highlighting their evolution from a contractual technique into a results-oriented model of economic administration. After reconstructing the concept and essential features of the institution, the article analyses the role of the principles of result, trust, and horizontal subsidiarity in reshaping the relationship between public authorities and the market. Particular attention is devoted to the allocation of operational risk and the preservation of economic and financial equilibrium, identified as the distinctive features of PPPs and the foundations of cooperation between public and private actors. The study further explores the regulation of project financing and the implications of the recent case law of the Court of Justice of the European Union concerning the promoter’s right of first refusal. Finally, it argues that PPPs represent one of the most significant expressions of the transition from a procedure-oriented administration to a results-oriented administration, emerging as a paradigm of a new form of economic governance based on collaboration, risk-sharing, and the creation of public value.
