The article examines the interaction between public procurement, criminal law and criminal procedure, highlighting public contracts as a sector particularly exposed to corruption, collusion and distortions of competition. The analysis focuses on the main criminal offences involved, including corruption, bid rigging, interference with the contractor selection procedure, trading in influence and corporate liability under DLGS 231/2001. Specific attention is devoted to evidentiary issues, personal and real precautionary measures, seizure, confiscation, and the relationship between criminal proceedings, administrative procedures and accounting liability. The article also emphasizes the role of compliance programmes, organizational models, whistleblowing, ANAC controls and European cooperation instruments. It concludes that an effective legal framework for public procurement must combine criminal enforcement, risk prevention, asset recovery and full respect for procedural safeguards.
