The scheme for «Optional quality terms» represents one of the most important innovations introduced by Regulation (EU) no. 1152/2012. After reviewing the political context in which it was elaborated and its scope, the paper examines the first and, so far, only facultative indication of quality «established » by the regulation: "mountain product", detailing in particular the conditions of use also as regards Commission Delegated Regulation (EU) no. 645/2014. Moreover, starting from interpretation of art. 28 of Regulation (EU) no. 1151/2012 relating to national rules which can be "maintained" in force, the Author analyzes whether Italian legislation on the term «mountain product» complies with EU law.
Keywords: Optional Quality Terms, Mountain Product, Voluntary Information, Consumer Protection, Protected Designations of Origin, Protected Geographical Indications.
