With the ruling in hand, the Council of State has intervened again on the subject matter of the concession of the state-owned maritime assets, in particular, on the institution of the forfeiture under art. 47 Italian Navigation Code. The attention of the Council of State dealt with the interpretation of the abovementioned provision with the aim of identifying the extent of the power conferred to the public administration to declare the forfeiture of the state-owned maritime concessions in case of substantial alteration and violation of obligations originated from the concession.
