The paper critically examines the jurisprudence regarding the dismissal of a disabled employee for being absent due to illness, addressing the issue of the employer’s knowledge of the disability status. In particular, the paper focuses on an aspect not yet examined by the Italian Supreme Court, which is that of the dismissal due to the excusable employer’s ignorance. On this point, the essay attempts to demonstrate how in such a case the employee still has the right to reinstatement in the workplace, in addition to monetary compensation equal to a minimum of five monthly wages.
