Hypnosis, nowadays applied almost exclusively in clinical settings, arouses growing interest in juridical contexts, albeit amid ongoing controversy. This article, by revisiting the current literature, explores two key areas: volition, crucial to criminal responsibility, and testimony, the cornerstone of evidentiary assessment. From this perspective, an in-depth analysis of these aspects appears essential to define the boundaries within which hypnosis may be legitimately integrated into the legal-forensic framework.
