The present essay focuses on the scope of the air passenger’s obligation to report for check-in for the purpose of recognizing the right to pecuniary compensation in air transport in the event of a long delay to the flight’s departure. Drawing on the ruling of the Court of Justice of the EU in case C-474/22, the analysis delves into the distinction between damage resulting from «loss of time» – typical of long delays and compensable through standardized measures – and individual prejudice, which instead requires a case-by-case assessment through an action for supplementary compensation. Finally, the study outlines the boundaries of the equivalence between long delays and flight cancellations, highlighting how the failure to be present at the airport precludes access to fixed compensatory remedies, without prejudice to the possibility of seeking redress for further damages suffered.
