This paper aims to note how the fiduciary element that can be linked to the broader concept of fides still permeates the entire employment relationship under a different perspective. In the initial phase of the relationship, confidence is detected from a subjective point of view as can be connectable from articles 2094 and 2086 of Civil Code and can be evaluated according to the general criteria of good faith and mutual respect. Instead, in the extinguishing phase, the fiduciary element becomes objectified, constituting the justification for the fulfillment of performance by the employee.
